Agreement to Terms

By accessing or using Create Coin ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Your use of the Service constitutes your acceptance of these Terms.

Description of Service

Create Coin is a platform that enables users to generate, compile, and deploy ERC20 token smart contracts on EVM-compatible blockchain networks. The Service provides:

• Smart contract code generation based on user configuration
• Contract compilation services
• Deployment transaction facilitation
• Contract source code and ABI download

We do not provide financial, legal, or investment advice. The Service is a technical tool for deploying smart contracts.

Eligibility and Account Requirements

To use the Service, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Comply with all applicable laws and regulations
• Not be prohibited from using the Service under applicable laws
• Have a compatible Web3 wallet (e.g., MetaMask, WalletConnect)
• Have sufficient native tokens to pay for gas fees and deployment fees

User Responsibilities

You are solely responsible for:

• Wallet Security: Maintaining the security of your wallet, private keys, and seed phrases. We have no access to your wallet and cannot recover lost credentials.
• Token Configuration: Ensuring the accuracy of token name, symbol, supply, and features before deployment. Contracts are immutable once deployed.
• Legal Compliance: Complying with all applicable laws, regulations, and tax obligations in your jurisdiction related to token creation and deployment.
• Contract Verification: Verifying your deployed contract on block explorers and ensuring it functions as intended.
• Gas Fees: Paying all network gas fees required for contract deployment.
• Prohibited Use: Not using the Service for illegal activities, fraud, money laundering, or any other unlawful purposes.

Fees and Payments

The Service charges a deployment fee in the native token of the selected blockchain network. This fee covers:

• Contract compilation and generation services
• Infrastructure and server costs
• Platform maintenance and development

Additional Costs: You are also responsible for paying blockchain network gas fees directly to the blockchain network. Gas fees are determined by network congestion and are not controlled by us.

All fees are non-refundable once a transaction is submitted to the blockchain, even if the deployment fails due to insufficient gas or other network issues.

Smart Contract Disclaimer

Prohibited Uses

You agree not to use the Service to:

• Create tokens for illegal activities, fraud, or money laundering
• Violate any applicable laws, regulations, or third-party rights
• Create tokens that infringe on intellectual property rights
• Create tokens designed to scam, defraud, or harm users
• Create tokens that violate securities laws or regulations
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to the Service
• Use automated systems to abuse or overload the Service

We reserve the right to refuse service to anyone for any reason, including violation of these Terms.

Intellectual Property

The Service, including its original content, features, and functionality, is owned by Create Coin and protected by international copyright, trademark, and other intellectual property laws.

Generated Contracts: Smart contracts generated through the Service are based on OpenZeppelin Contracts (MIT License). You own the contracts you deploy, but the underlying OpenZeppelin code remains subject to its license terms.

Your Content: You retain ownership of any token configurations, names, and symbols you provide. By using the Service, you grant us a license to use this information solely for providing the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATE COIN AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of funds, tokens, or cryptocurrency
• Loss of profits or business opportunities
• Data loss or corruption
• Security breaches or unauthorized access
• Errors or bugs in generated contracts
• Network failures or blockchain issues
• Gas fee miscalculations or excessive fees

Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Create Coin and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your deployment or use of tokens created through the Service
• Any third-party claims related to tokens you create or deploy

Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues or bugs
• Third-party service outages
• Blockchain network issues
• Force majeure events

We are not liable for any losses or damages resulting from Service unavailability.

Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may also change fees, features, or functionality at our discretion.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may stop using the Service at any time by disconnecting your wallet and ceasing to access the platform.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

If you do not agree to the modified Terms, you must stop using the Service.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Create Coin regarding the use of the Service and supersede all prior agreements and understandings.
